Welcome to Imaginest AI, operated by Nestly LLC. By accessing or using our App, you agree to be bound by these Terms of Use. These Terms constitute a legally binding End User License Agreement ("EULA") between you and Nestly LLC.
1. Description of Service
Imaginest AI uses Artificial Intelligence to transform photos. You understand that AI generation is unpredictable and may not always produce the desired result.
2. Virtual Currency (Coins)
- The App uses a virtual currency ("Coins") to pay for AI generations.
- Coins have no real-world monetary value and cannot be exchanged for cash or transferred to other users.
- Refunds: Purchases of Coins are final and non-refundable, except as required by law or decided by Apple. However, if a generation fails due to a technical error, the App automatically refunds the Coins to your in-app balance.
- Expiration: If you delete your account, your Coin balance will be permanently lost.
3. Subscriptions
- We offer auto-renewing subscriptions (Weekly, Yearly) that grant you a specific allowance of Coins per period.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- You can manage or turn off auto-renewal in your Apple ID Account Settings at any time.
4. User Conduct
You agree NOT to use the App to:
- Create deepfakes of public figures, politicians, or celebrities for malicious purposes.
- Create sexually explicit, hateful, or illegal content.
- Upload photos of others without their consent.
We reserve the right to ban users who violate these rules.
5. Intellectual Property
You retain ownership of the photos you upload. Nestly LLC claims no ownership over the original photos or the AI-generated results, subject to the license granted to us solely to process the image.
6. Disclaimer of Warranties
The App is provided "AS IS". Nestly LLC makes no warranties regarding the quality or accuracy of the AI-generated images.
